21.05.27.1427Th PLATFORM OR PUBLISHER – THIS IS THE QUESTION?
Apart from this life being packed full of questions, as I suspect it always will be, this one is singularly important to the viability of Individual Liberty in modernity.
It being my understanding that PLATFORMS are exemption from persecution & held harmless legally with regard to thoughts expressed by individuals THEY HAVE NO CONTROL OF posted on their PLATFORM. In other words, PLATFORMS are given a general dispensation legally for what might appear on their PLATFORM not produced by them. Leaving responsibility where it belongs – with its creator. Seems perfectly reasonable to not hold someone liable for the actions of another.
But then we have the PUBLISHER who without doubt has control over what, when, where & even how anything is PUBLISHED by them – therefore any exemption from responsibility would be utterly wrong due to have complete control of whether or not to PUBLISH A THING.
If I understand the these terms correctly, then how they (these terms) are being manipulated for the express purpose of hampering & interfering with free speech provided every citizen by the 1st Amendment to the Constitution of the United States of America – how else can it be seen?
Also if I’m correct there is no doubt as to the culpability of these Big Tech wishy-washy conglomerates that shape-shift according to what suites their whim(s) at any moment to accommodate their ravaging and/or curtailing of Individual Free Speech in America?
PS. Just what would a massive Class Action look like in Federal Court against Big Tech for denial of Constitutional rights to freedom of speech – massive indeed?
For that matter why wouldn't RICO be applicable as it's commerce crossing state lines?
