The Jussie Smollett case is just tying me up in knots. In an age that has just legislated a 'vague' and open term such as 'hate crime', how should we classify this particular case? It is clearly so much more than wasting police time and resources in a city riven with violent crime. Had this incident taken place , say, in the middle of summer after yet another period of mass shootings, there would have been serious and bloody consequences. This case is a hate crime, by any measure... not just by SJW standards

It shows how hate toward MAGA people clearly IMO, so it is a hate crime to me.

Jesus, everyone needs to calm down. Yes, Smollett was pinheaded for the “publicity stunt”. However, both the left and right provide fertile ground for this crap as the left has set the stage with its postmodern victim hood intersectionality wo-wo, and the right with it’s near constant see no evil blinders. With a little critical thinking skill one can feel some gratitude as no great disaster was reported.

We need to be consistent.

How would society have reacted if Smollett and his accomplices/attackers had been white and he had indicated a pair of (fictitious) black men wearing Black Lives Matter hats had committed the crime?

Would the true damage in that case be recognized as degradation of race relations in a city and situation that is already more than a bit on edge?

Once the scheme was known, would there not be demonstrations in the streets of several major cities against the accuser's blatant racism?

Would the authorities limit themselves to charging the lying accuser with a single count of false reporting?

While it is true that no one died in this incident its consequences are not yet known.

I see his FALSE REPORT of a "hate crime" AS a "hate crime." Whatever the sentence enhancement for a "hate crime" over its corresponding "regular" crime should apply to his hoax as compared to a "regular" false report.

All crimes could be classified as "hate" crimes. Crimes, by definition, are not loving. Smollet's is certainly classified as a crime against truth.

18 UScode 1038...the mailing of the white powder is a federal crime. 5 years and fines if they choose...but it also is civil meaning law agencies can sue to recoup any resources used...thinking the DOJ will step in once the Chicago Pd has finished it's full investigation...that will allow all the hours involved to be "billable" after the fed steps in

Has there been recent legislation in regards to "hate crime"? The last time I checked, the supreme court had still upheld that it was not a legally valid concept.

That is difficult to answer as you pointed out that this IS a vague term.

I believe this was not a hate crime, it was a crime of greed and opportunity.

Greed foremost but also realizing the opportunity coming from the sheer stupidity that has come from recent political slideshows regarding victimhood. As in, Believe Women, Black Lives Matter to name just 2.

Both of these statements are true but being true does not preclude fair examination in the real world which at this point would be called patriarchal oppression or racist.

So in the actions being called racist it opens up a world of opportunity for those selfish enough to grasp the opportunity because the moment the opportunity is seized we are expected to go past any evidence and straight to belief which makes false claims like this lucrative.

Unless of course whatever is being perpetrated is beyond belief, in which case victimhood (an all purpose catchphrase which will hopefully cover any responsibility) speedily becomes the second defense.I

In this particular case, in my opinion, Smollett just picked off the low hanging fruit. He seemed to think no one would consider the facts but instead would head directly to white men hate blacks so they must have done this....

Which was what initially happened!

He should have learned from his first attempt but he didn't he simply ramped up the drama and now MAY have to face repercussions for his greed.

I say may because the left will do everything in their power to erase the embarrassment of jumping the gun to a perceived hate crime and justice means nothing if it hinders their talking points.

So can this considered hate crime, yes, but one perpetrated by people long dead, he just seized the fruits of their labor, so in this case I would say no.

But I DO believe that if he manages to evade prison by crying victim.20 the city of Chicago's police department should be able to sue him for theft of man hours while committing larceny. Now THAT would hurt him where he evidently lives.
