We have back ground checks. They don't always work because not all relevant information gets entered into the system. Sometimes human error, sometimes intentional. We can't eliminate the human factor!!!
John Q. Smith will always have a problem, as will anyone with a common name.
They need to take advantage of the technology that already exists. Creating a VERY SIMPLE application that takes a name and a state and returns a pass/fail based on state laws in the background check is a possibility. Of course, since there are some duplicate names in any given state, it would need to return some verifiable info as well. Either way, it's a simple solution to the background check question.
The bigger question is whether or not universal background checks are a violation of the 4th Amendment. IMO - That should probably be a yes.
