We must push back against the state of emergency that Trump is attempting to do. When/if the socialist are elected we may regret the executive branch overreaching against article 1 of the constitution

This is missing the mark.
If a socialist president is elected we are screwed no matter what.
They don't care about rights, laws, or the Constitution.

California, New Jersey, New York are giving Id's and Drivers Licenses to illegals.
If we don't seal the border and deport... There will never be a conservative elected again.

Trump is our very last chance. If he fails, its civil war.

I agree. The border is important but libs will use this mechanism to strip us of our rights

I appreciate all of the feedback. I feel the same way about protecting our boarders as many of you. This is an emergency. However I also feel that this is a usurpation if the power of the purse. This could be a very dangerous precedent.

usurpation of the power of the purse? howso? If we don't stop this goddamned invasion, we will not have a country to worry about. If you feel this is not an emergency, just put your "welcome" sign in the front yard and take all the locks off your doors...... We elected Trump to actually DO something about this, and most of us think this is pretty damn tame stuff. When Democrats are elected, they NEVER worry about setting a precedent that a Republican may use, they try to make sure a Republican is never again elected. Wise up.

I disagree. There IS an emergency att the border. Aside from drugs flowing into the US and costing us billions, illegal immigrants also flood in and use resources they don’t pay for and cost American taxpayers millions. I’d rather my money go to help Americans

I understand your concern. Congress created the law and he is following the law. Congress has the power to change the law. It really is that easy to fix. If only we still were a nation where everyone followed the law.

Trump didn't let this genie out of the bottle. It was let loose the day the National Emergencies Act was signed into law back in 1976.

This, [thehill.com] is a good read on the matter.

Upshot:

"Trump’s declaration of a national emergency to build the wall derives from that singular authority in the National Emergencies Act (NEA), passed by Congress in l976. Since then, presidents have resorted to the NEA 58 times. In each case, the president — Democrat and Republican — spent funds not appropriated by Congress and the Supreme Court did not overturn the action..."

My question is why should we push back on this declaration when we didn't bother to push back on the previous ones? What's different?

Answer: Nothing.

Personally, I feel that the NEA is certainly an overreach from the get-go. The whole thing should be repealed, but I'm not holding my breath because the precedence was established all the way back when it was first utilized in the Carter Administration.

This is life on the slippery slope.

OK this makes me really angry. I agree with you but my moron Senator (not to be confused with my recently reelected NPC senator) voted against Trump's state of emergency declaration specifically. Instead of fixing the legislation that opened the door he just virtue signals by voting to specifically deny Trump.

Its not overreach when the legislature abdicates its responsibility. We really need to get our Congress back into a working condition

I concur that Trump's decision to go ahead with the Executive order was probably something we'll regret. Similar situation to the Democrat nuclear option. Democrat Socialist gets elected, there's a mass shooting by some crazy nut, and our newly elected Facist (excuse me, Socialist) President will declare an emergency and start gun confiscation. I figure this will happen early on in the new American Socialist society.

you are comparing apples to Oldsmobiles. There is no Constitutional amendment guaranteeing anyone the right to invade this country,--- we do however have a Second Amendment to stand behind.

I hear what you're saying, but the precedence was already set, with executive order under Obama of Deferred Action for Childhood Arrivals, DACA.

The precedent was set decades before that. It was set with the first president to declare a national emergency under the NEA. That was Carter.

How the NEA is used is not the issue. It's the principle of the NEA.

I have watched most every elected liberal in my lifetime "overreach". Nearly every president in modern history has declared a "national emergency" to the benefit of foreign entities. Nothing we do will stop them. So we might as well get something out of it for once.

I understand your concern.
