If a woman falsely accuses a man of rape, and openly admits she lied, she she go to jail. What’re your opinions on this thought?

Absolutely! I would argue she should also pay civil fines to offset the man's pain and suffering.

Agreed...but it's very expensive to sue someone in Supreme Court in Canada. Lawyers have told me it may take a minimum of $25,000 and it's very difficult to navigate Supreme Court without a lawyer. Of course, it would cost the woman as well. If she doesn't have money to begin with the lawsuit would be useless. Maybe it's easier and cheaper to sue in the States.

Yes. I believe a person who makes false claims or gives false testimony should go to prison.

To falsely accuse someone of a crime is a crime.
You have commited either liable and/or slander. Libel and slander are both types of defamation. Libel is an untrue defamatory statement that is made in writing. Slander is an untrue defamatory statement that is spoken orally.

Defamation of character is definitely a prosecutable & punishable crime. Yes, she should be held accountable and punished to the extent the law allows.

Such a person has committed more than one offence.

  1. Giving false information to police
  2. Swearing a false statement - perjury
  3. Possibly libel

For each of these there should be a substantial penalty; which should factor in the waste of police time and also the damage to reputation of the innocent party. Such false claims are a very serious offence and it is annoying that very often people seem to think false claims are only minor.

Any false accuser should receive the same punishment that they were trying to give to someone else. A fake rape accuser INTENTIONALLY tried to get an innocent guy to receive the punishment of a rapist. Thus, she should get the same punishment a rapist would.

She should get the exact sentance the accused would have received. Ni more, no less.

I think more time because she has committed multiple crimes ... slander/perjury, also false accusations ... she has hurt the credability of other rape victims ect. ... so I feel she should get more time !

Yes everybody must pay for false accusation. False accusations are not accidentally, the accuser make them to destroy somebody's life. Today's judiciary system is corrupt and don't take them seriously, as the result more and more lifes will be destroyed.

I agree. If she accused him while she was under oath or in a signed police report she may be charged with lying under oath or submitting a false police report anyway. Notice I said "may." In this day and age we can't expect justice to be served.

Yes she should. Rape is a very serious charge and is one that people will almost always remember that the man was charged. Even if the woman recants or he is found d not guilty, some people will always assume he just got away with it.

It's a case of were will it end if no punishment is given. A women finally got punished after accusing 10 men. Accusation like this can be devastating to a person's life. Financial, emotional, relationship, family, children. Yes with the first proven false claim punished should fit the crime.

I more wanted to bring up the catch 22 here in that particularly in the face of harsh punishment, especially where the punishment is just go to jail, there is disincentive to come clean about the lie. People who are sociopathic enough to lie about rape are probably also sociopathic enough to let someone stay in prison rather than go there themselves.

Theres a lot of "eye for an eye" here. I wouldnt want that, she should be punished for the crimes she commited.

Rape accusations is quite devastating for someones life but really the best that can happen is that the accuser says its a lie.

But there might still be consiprarionists who will try to sell the story that the girl was paid off. For that reason i think one of the punishments should be jail.

You can have as many laws as you want but if the judiciary don’t execute them & give strong sentences then they have no value & disencentivise people from suing. So the false accusations continue & the left grow stronger.

Certainly a person who lies and causes an innocent person to be unjustly punished should be held strictly accountable. People should also be held accountable for a false report even if it doesn’t have direct harm to a specific person. However, IMO, the specific facts and circumstances in the case must be taken into account when punishment takes place. For example, if someone was actually raped but errs in identifying the rapist certainly they should not be punished to the same level as the person who intentionally lies for political purposes. In your scenario the accuser admits to intentionally lying so significant jail time is in order, but I would think the amount of time would have to depend on if a specific person is harmed and the severity of harm. For example, if the false accuser recants before an innocent is sent to jail, the punishment should be less severe than if the innocent party was imprisoned.

It can be tough to say for sure. If the person admits that it was a false accusation then definitely some form of criminal and civil punishment. The law would need to be framed in a way that victims do not have to worry about getting in trouble for reporting the incident while allowing false accusations with harmful intent to be able to be punished.

Not only should she go to jail but she should be there for the maximum amount of time that the man was facing ... with no chance of parole or early release as what she has done not only makes the accused Male a victim but also hurts the credibility of every actual rape victim!!
