Feel free to reply to any comment by clicking the "Reply" button.It is not uncommon for Supreme Court justices to write a dissenting perspective on an official Supreme Court decision. What is uncommon is when the dissenting opinion is portrayed as the only honest opinion worthy of consideration. I didn’t see the verbiage of the dissenting piece, so I can’t say where her's fell WRT appropriateness.

Although I didn’t see the verbiage of her dissenting opinion, it would t surprise me to see her activism. All throughout the Osama administration, I condemned an activist judicial branch for legislating from the bench. (Along with an impotent legislative branch and a tyrannical executive branch).
I’m glad to see the judicial branch filled with more justices that will interpret the law rather than trying to make new laws.
@Daveclark5 keep in mind that the Legislature is only impotent voluntarily - they have absolutely deliberately abdicated their duties and are all to happy to sit back and allow the Judiciary to "legislate from the bench".
Since Senators and Congressmen are elected there is some risk in arguing for and introducing law as proscribed in the US Constitution. The risk of offending or alienating enough voters that it puts the very careers of the Legislature members at risk.
So it is politically expedient and preferable to allow the Bench to take on the burden that otherwise would be on the shoulders of the members of Congress. Judges are not elected and it is all but impossible to unseat a Judge.
@ithink, that’s the way I see it too. That’s also part of why I am so insistent that there needs to be term limits for the legislative branch and no retirements or going directly into any government-contracted jobs that pay them to rob the taxpayers money. They should be forced back into the regular workforce after no more than a decade (and that doesn’t mean taking an extra million dollars with them).
