Feel free to reply to any comment by clicking the "Reply" button.I don't think you can make an argument that it is inappropriate for the intelligence community to investigate an incoming administration. The issue is how that investigation was conducted. The parties being investigated must know they are being investigated and the investigation must be impartial. It is kind of shocking that there is no standard procedure for transition.
So we are left with the difficult question of what constitutes abuse of power. What has to be proven is that the investigation into the Trump administration were not for national security but we're politically motivated. The evidence is in the lies told. Under normal circumstances you could make the occam's razor argument of a cover up of incompetence. In this case Biden has recently apparently lied about knowing Flynn was unmasked. It is hard to see how unmasking can be explained by incompetence or why someone would lie about it if was ethical.
I'm also concerned that although we can logically established misconduct by the Obama administration the presumption of innocence still applies. The standards for criminal conviction under our system are high. Unless of course you are not a Democrat in front of a Democrat judge. The bias is so evident but is legally irrelevant. What a mess and this is not a unique case. It happens all the time.
