The Constitution and the Tenth Amendment are clear that the Federal government are only allowed to regulate interstate commerce and provide the military. All other Federal bureaucracies are unConstitutional.

I can't quite square that conclusion. Article l, Section 8 of the Constitution lays out most of the responsibilities of Congress and they clearly can establish a Dept. of the Treasury and of Immigration, as well as others.

Am I mistaken?

@FrankZeleniuk I stand corrected on three points: that Congress is charged with establishing the Department of the Treasury, a Post Office, and the Patent Office.

You'll notice below that Congress will collect taxes to fund what the government does, but it does not include administering them. Congress will also make rules about immigration, but the President was charged with its administration by Congress, as provided in Article 2, Section 2.

Nowhere appears such things as Federal bureaucracies such as the Department of Education, any agency even remotely like the FBI, the HSS, the Department of Justice...over 2000 agencies without even a hint of justification in the Constitution for over half of them. (About half are executive, judiciary, and military, which are Constitutional.) So I stand by the point of my comment, that most government jobs are not Constitutional, nor consistent with the Tenth Amendment.

Section 8 - Powers of Congress. The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

To raise and support Armies, but no Appropriation of Money to that Use shall be for a longer Term than two Years;
To provide and maintain a Navy;
To make Rules for the Government and Regulation of the land and naval Forces;

Article 2 - The Executive Branch
Section 2 - Civilian Power Over Military, Cabinet, Pardon Power, Appointments. The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any subject relating to the Duties of their respective Offices, and he shall have Power to Grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.
He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.
